Context

 

Baoyin Oriental Dance is considered to be in a relationship of trust with its dance students, when they falls within the definition of a child, and care must therefore be taken to ensure that there is no abuse of trust as set out in law. The relationship between any member of Baoyin Oriental Dance and students of Baoyin Oriental Dance is a professional one; it is not, and normally should not be, a personal relationship such as that exists between friends and relatives and that between businesses and organisations.

 

Aims of this Policy

 

• To protect children. The definition of a child under the Children Act 1989 is a young

person under the age of 18.

 

• To protect staff against false or exaggerated claims or accusations by students. These may be malicious, or mistaken, i.e. made in good faith by a student who has isinterpreted words or actions. For the protection of a member of Baoyin Oriental Dance, the definition of a student for this policy is a young person of any age, up to last day of dance lesson of the academic year in which he or she is enrolled at Baoyin Oriental Dance.

 

• To comply with all relevant legislation, in particular that dealing with the protection of

children, including the Sexual Offences (Amendment) Act 2000 which created a new offence of abuse of trust.

 

• To clarify relationships, Baoyin Oriental Dance is a dance business and a person enrolled in this capacity is a student or a buyer of services and all efforts must be made by all not to confuse this student relationship with friendship, kinsman-ship, comrade-ship, business relationship and community relationship.

 

Principles

 

1. The relationship between Baoyin Oriental Dance and students is a professional one.

2. The basic assumption in this policy and guidelines is that Baoyin Oriental Dance is acting professionally at all times,

3. A personal relationship between Baoyin Oriental Dance and a student who is also a child is inappropriate unless it is with the full knowledge and consent of the parents or guardians.

4. All interaction between Baoyin Oriental Dance and students is carried out in a professional manner and in a professional context.

5. Where a student come from an organisation (such as a community group) rather than as an individual, Baoyin Oriental Dance is not responsible for the membership, policies and guidelines and  operating details (such as logistics) of such an organisation

6. Before, during and after each dance activity Baoyin Oriental Dance service is purely professional and is therefore unable to reciprocate personal favours at these times. Example of personal favours would be car lift for students and child minding (there may be implication of a minimum requirement of two CRB checked persons to accompany a journey).
